Warranty Against Defects – shop.ch-s.com.au

This warranty against defects applies to eligible goods purchased from shop.ch-s.com.au and delivered within Australia only. It deals strictly with defects in goods and does not cover change-of-mind returns, order errors or similar matters, which are addressed separately in our returns and refunds policies.

2. Your Rights Under the Australian Consumer Law

When you buy goods from us, you automatically receive consumer guarantees under the Australian Consumer Law. These guarantees include that goods will be of acceptable quality, match their description or any sample or demonstration model, and be reasonably fit for any purpose you made known to us.

These rights:

  • apply automatically and do not need to be written in a contract;
  • cannot be taken away or limited by our terms, any “no refunds” sign, or by this warranty; and
  • may continue for a reasonable time after purchase, depending on the nature of the goods.

If there is a problem with goods that falls under the consumer guarantees, you may be entitled to a repair, replacement, refund and, in some cases, compensation for reasonably foreseeable loss or damage.

The rights in this section exist in addition to the voluntary warranty against defects described below.

3. Our Voluntary Warranty Against Defects (Goods)

In addition to your consumer guarantee rights, we provide the following warranty against defects on eligible goods purchased from shop.ch-s.com.au. This warranty applies to all customers (consumers and ABN customers) purchasing goods through our online store, provided the goods are delivered within Australia.

3.1 What This Warranty Covers

Subject to the exclusions in section 3.3, we warrant that goods supplied by us will be free from defects in materials and workmanship under normal, intended use for the warranty period set out in section 3.2.

If a covered defect appears during the warranty period, we will, at our option:

  • repair the goods; or
  • replace the goods; or
  • provide a refund or other appropriate compensation.

This warranty applies only to the original purchaser and is not transferable.

This warranty against defects is in addition to, and does not limit, your rights under the Australian Consumer Law.

3.2 Warranty Period

Unless a different period is specified on the product page, invoice or accompanying documentation, the warranty period for our goods is:

12 months from the date of purchase.

You may still have rights under the consumer guarantees after this period ends, if it is reasonable for the goods to last longer, having regard to their type, price and expected use.

3.3 What Is Not Covered

This warranty against defects does not cover:

  • normal wear and tear;
  • overloading or use above the working load limit (WLL) or rated capacity of the goods;
  • use outside relevant Australian Standards, industry guidelines or any instructions or warnings supplied with the goods;
  • use with non-compatible components, fittings or accessories that are not suitable for use with the goods;
  • corrosion or environmental exposure beyond normal industrial conditions (for example, severe chemical exposure or immersion not contemplated by the product’s design);
  • use of the goods in commercial hire or rental applications – such use is not covered by this warranty and will be subject to separate hire terms and conditions;
  • damage caused by misuse, abuse, neglect or improper storage or handling;
  • damage caused by incorrect installation, assembly, adjustment or maintenance, including failure to follow any instructions or warnings supplied with the goods;
  • damage caused by unauthorised modification or repair; or
  • goods where identification labels or markings have been removed, altered or defaced.

These limitations relate only to this voluntary warranty and do not affect your consumer guarantee rights.

4. Manufacturer Warranties

Some goods may also be covered by a separate manufacturer warranty. Where a manufacturer warranty applies, you may, in addition to your rights under the Australian Consumer Law, be able to obtain a remedy under that warranty.

If you believe you have a claim under a manufacturer warranty for goods purchased from us, please contact us first using the details in section 1. We will advise whether we will handle the claim on your behalf or assist you in contacting the manufacturer directly.

5. How to Make a Warranty Claim

You should notify us of any suspected defect as soon as practicable after you become aware of it, and in any case within the 12-month warranty period.

To make a claim under this warranty against defects:

  1. Stop using the goods if further use may cause damage or a safety risk.
  2. Contact us using the details in section 1 and provide:
    • your name and contact details;
    • proof of purchase (invoice, order confirmation or receipt);
    • a description of the goods (and serial number or identifying marks, if applicable);
    • a clear description of the defect and when it first appeared; and
    • photos or videos of the issue, if possible.
  3. We will confirm the correct return address (Sydney, Brisbane, Melbourne, Perth warehouse) when you lodge your claim. Do not return goods until we have provided instructions.
  4. For large or installed equipment, we may arrange on-site inspection or request additional photos or videos before deciding whether goods need to be removed or returned.

5.1 Costs of Making a Claim

You are responsible for arranging return of the goods to us in the first instance. If your claim is accepted as a valid warranty claim, we will reimburse your reasonable standard road freight or postage costs on proof of payment, and cover the cost of sending repaired or replacement goods back to you. We do not reimburse express or premium freight charges unless required by law.

5.2 Assessment and Response Time

Once we receive your claim (and any goods we have asked you to return), we will assess the goods and determine whether the issue is covered by this warranty and/or your consumer guarantee rights.

We aim to respond to warranty claims within 5 business days of receiving all necessary information and, if required, the returned goods. Where a remedy is due, we will provide repair, replacement or refund within a reasonable time, having regard to the nature of the goods and the defect.

If we determine that the defect is not covered by this warranty, we will explain why. If you ask us to proceed, we may offer a paid repair or return freight at your cost.

6. Mandatory Australian Consumer Law Wording

The following wording is required under the Australian Consumer Law for warranties against defects relating to goods supplied to consumers:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. Relationship Between This Warranty and Consumer Guarantees

This warranty is a voluntary additional benefit that we provide. It does not replace, limit or exclude your consumer guarantee rights under the Australian Consumer Law, which may give you a right to repair, replacement, refund and, in some cases, compensation even after our stated 12-month warranty period, where that is reasonable for the goods.
